I reject the idea Democrats did this on purpose as a kind of double-dog dare to judges. Things like this happen when you pass laws in the middle of the night without reading them. Democrats are going to regret this error.

  1. The clause was left because what was passed by the Senate was a draft! The clause is usually added during reconciliation of the house and Senate versions. But since there was no reconciliation because the Senate initial version as passed had to be passed by the House since Sen Kennedy passed and the Dems lost their Fillibuster proof majority. It missing for the simple reason is was passed to shove it down our throats. The comments in this clip are blatant lies about the facts of why this clause is missing.
