A yearlong investigation by the House Armed Services Committee has concluded that the Obama administration broke the law in swapping five Taliban members for Army Sgt. Bowe Bergdahl — and went out of its way to hide the negotiations as they were happening.
The report said the administration broke a law requiring it to give members of Congress 30 days’ advance notice of any detainee transfers from the Guantánamo Bay detention facility, where the senior Taliban leaders were held.
It also found that it misled reporters and lawmakers about a potential prisoner exchange. Congress was instead notified just hours before the May 2014 transfer took place.

Surprise: One of Taliban swapped for Bergdahl trying to return to militant activity...

Washington (CNN)The U.S. military and intelligence community now suspect that one of the five Taliban detainees released from Guantanamo Bay in return for Sgt. Bowe Bergdahl in May of last year has attempted to return to militant activity from his current location in Qatar, CNN has learned exclusively.The development has led to an ongoing debate inside the administration about whether there is a new threat from this man, and potentially the other four.This is the first known suggestion that any of the detainees involved in the exchange may be trying to engage again in militant activity. It comes at a politically sensitive time as the administration has quickened the pace of prisoner release in an effort to encourage the closure of the Guantanamo, and the Army must decide in the coming weeks whether and how to punish Bergdahl for leaving his post.

Report: Sgt. Bowe Bergdahl to be charged with desertion...
We gave up five high-ranking Taliban commanders to get Bergdahl back. The alleged charge hasn't been officially announced.

Tony Schaffer told Bill O’Reilly on “The O’Reilly Factor” Monday.Mr. Shaffer, who now works for the London Center for Policy Research, said two separate military sources have confirmed to him that Sgt. Bergdahl’s attorney has been given a “charge sheet,” listing out the articles of the uniform military code that have been violated.“The army has come to its conclusion and Bowe Bergdahl will be charged with desertion,” Mr. Shaffer said.

The Pentagon is under fire for making a ransom payment to an Afghan earlier this year as part of a failed bid to win the release of Army Sgt. Bowe Bergdahl, according to U.S. officials.
Sgt. Bergdahl was released in May after nearly five years in captivity as part of a controversial exchange for five terrorists held at the U.S. military detention facility at Guantanamo Bay, Cuba.
The ransom payment was first disclosed by Rep. Duncan Hunter in a Nov. 5 letter to Defense Secretary Chuck Hagel. Mr. Hunter stated in the letter that Joint Special Operations Command (JSOC) made the payment covertly as part of a release deal. But the money was stolen by the Afghan intermediary claiming to represent the Haqqani terrorist network.

The House voted 249-163 to disapprove of President Barack Obama’s transfer of five Guantanamo Bay detainees for Sgt. Bowe Bergdahl, providing a soft rebuke of the president’s actions on the prisoner swap.
On the nonbinding resolution vote, 22 Democrats joined all 227 voting Republicans to condemn the administration for not providing the 30 days of notice required by law before transferring a prisoner at the Guantanamo Bay Detention Center.
Armed Services Chairman Howard “Buck” McKeon, R-Calif., called the prisoner swap an “obvious” violation of the law, and he said Congress needed to understand the national security risks posed by transferring detainees before such a swap takes place.

A nonpartisan government watchdog agency said Thursday that the Pentagon broke the law when it swapped five Taliban leaders for Army Sgt. Bowe Bergdahl earlier this year.
The Government Accountability Office, in a legal opinion issued at the request of congressional lawmakers, said the Defense Department violated the law by failing to notify key Capitol Hill committees at least 30 days in advance.
Further, the report said the Pentagon broke another law by using funds that were not technically available.
Defense Department press secretary Rear Admiral John Kirby told Fox News Thursday night, "the operation to retrieve Sgt. Bergdahl was lawfully conducted and that was also the judgment of the Justice Department. Nothing has changed about our view that this was a lawful recovery operation."
The GAO said the law in this case is "clear and unambiguous." The agency said that while the Defense Department defended the legality of the controversial swap, "in our view, DOD has dismissed the significance of the express language" in the law.

Reported details of the high-profile prisoner swap that freed Bowe Bergdahl over the weekend are not telling the full story, according to a high-level intelligence official involved in efforts to find and rescue the Army sergeant.The Haqqani Network, a terrorist group operating in Afghanistan and Pakistan, freed Bergdahl on Saturday after holding him captive for five years in exchange for the release of five Guantanamo Bay prison inmates.A senior intelligence official with intimate knowledge of the years-long effort to locate and rescue Bergdahl told the Washington Free Beacon that the details of that exchange do not add up.The official, who requested anonymity because he is not authorized to speak to the press, speculated that a cash ransom was paid to the Haqqani Network to get the group to free the prisoner.

HAILEY, Idaho, June 4 (Reuters) – The hometown of U.S. Army Sergeant Bowe Bergdahl has canceled a rally planned for later this month celebrating his release from five years of Taliban captivity, a municipal official told Reuters on Wednesday, amid allegations that he was a deserter.
Heather Dawson, the city administrator of Hailey, Idaho, said town officials called off the June 28 event at the request of organizers because the town “will be unable to safely manage the number of people expected.”
The decision came as the small mountain community was coming under mounting pressure to cancel the rally amid rising anger over claims by some of Bergdahl’s former Army comrades that he had deliberately abandoned his post in Afghanistan

Bowe Bergdahl was captured by the Taliban during combat, a dramatic change from their explanation just a day earlier.On Monday, State Department Spokeswoman Jen Psaki was asked several times if the government saw Bergdahl as someone who was trying to desert from the Army. That question was a reaction to press reports based on soldiers who served with Bergdahl.Psaki rejected that theory on Monday, and said Bergdahl was captured during combat.“We would characterize him as a member of the military who was detained while in combat,” she said.On Tuesday, another State spokeswoman, Marie Harf, retreated by saying officials are in the process of finding out what happened. Harf keyed off comments that Joint Chiefs of Staff Chairman Martin Dempsey made on his Facebook page, which also said the military will soon learn what happened.

Military-related blogs, Twitter accounts and Facebook pages were filled with screeds from commenters accusing Bergdahl of being a “traitor” or a Taliban “collaborator.” The online publication The Daily Beast published a nearly 2,000-word first-person account by a former Army infantry officer who said he was privy to details of Bergdahl’s disappearance and who stated flatly that “he was a deserter, and soldiers from his own unit died trying to track him down.”
The mother of one of six soldiers who’ve been identified as being killed in circumstances related to the search for Bergdahl was furious over the opaque handling of the case, telling Army Times that the Pentagon “really owes the parents of these fallen soldiers the truth.”
But instead of addressing the desertion issue head-on, complained many military analysts and war veterans, the Obama administration is allowing the debate to fester, only deepening the skepticism of current and former service members who demand to know how Bergdahl left his unit, how many U.S. forces were killed in the search effort, and whether there are plans to conduct a legal review of his case and, if necessary, prosecute him.
Michael Waltz, who as an Army major commanded U.S. Special Forces in eastern Afghanistan at the time Bergdahl disappeared, said the sergeant deserted and shouldn’t have been accorded POW status.
“He just walked off after guard duty and wandered into the nearby village,” Waltz told McClatchy in an interview Monday...
