(Cns) The solicitor general calls what Obama is doing "prosecutorial discretion."
He argues that under this particular type of "prosecutorial discretion," the executive can make millions of people in this country illegally eligible for Social Security, disability and Medicare.
On April 18, the Supreme Court will hear arguments in the case. Entitled United States v. Texas, it pits President Obama against not only the Lone Star State, but also a majority of the states, which have joined in the litigation against the administration.
At issue is the policy the administration calls Deferred Action for Parents of Americans and Lawful Permanent Residents, which would allow aliens in this country illegally who are parents of citizens or lawful permanent residents to stay in the United States. Read it all...

DHS Jeh Johnson: Illegals are “in effect” citizens

The nation’s top immigration officer said that the “11 million” undocumented aliens in the United States are “not going away,” are “in effect” citizens, and added that deporting the few the administration wants out is unpleasant.
Jeh Johnson, secretary of Homeland Security, told Harvard University students this week that the administration is focused on its plan to integrate illegals into America, despite the policy being tied up in court.

An Egyptian immigrant in the U.S. on a student visa is getting deported after making threatening remarks about Republican presidential candidate Donald Trump.
According to the website Egyptian Streets, Emad El-Din Ali Mohamed Nasr El Sayed, was arrested three weeks ago after police say he posted a death threat against Trump on Facebook.
“I am willing to kill Donald Trump and serve a life sentence,” El Sayed said on Facebook. “[T]he whole world would thank me for doing that.”
It may or may not have been serious, but in any case it appears likely to cost El Sayed. He was arrested by local police Feb. 12.

Only about 3 or 4 percent of the unaccompanied minors who have entered the country in the last two-and-a-half years have been returned to their home countries, Sen. Jeff Sessions charged on Tuesday.
“It cannot be that every young person that appears from Central America is entitled to asylum or entry into the united states, contrary to our laws,” Sessions said during a Senate Judiciary Committee hearing on Tuesday. “It just cannot be. Does anybody in this government not understand that?”
Immigration officials testified that the border crisis could be mitigated if more people were sent home. “I don’t disagree with that,” Thomas Homan, a senior official at Immigration and Customs Enforcement, told Sessions. “I think if you have a consequence of deterrence to illegal activity, the illegal activity will slow down.”

Toms River Police say an immigrant in the country illegally — again — tried to kill a police officer has he dragged the cop with his car while fleeing the scene of an investigation Tuesday.
Giomar Diaz, 33, whose last listed address was in the Bronx, was held in lieu of $500,000 bail on charges of attempted murder, aggravated assault on a police officer, and resisting arrest.
According to Toms River police, Diaz appears to be in the United States illegally and currently is being held on an additional no-bail detainer from the U.S. Immigration and Customs Enforcement Division. Police say the believe he was previously detained on weapons and drug charges and deported to the Dominican Republic.

• The IRS accepts millions of tax returns – and issues tax refunds – even when taxpayer documents show clear warning signs of identity theft
• Confidential IRS policies instruct IRS employees not to tell taxpayers when someone else uses their social security number to earn income
• The IRS allows illegal immigrants to "borrow" social security numbers that do not legally belong to them
• The IRS is discontinuing a program to notify taxpayers when their social security number is used by someone else to gain employment

The Obama administration deported a record-low number of criminal immigrants over the last year, according to government figures not publicly released by the Department of Homeland Security.
The Associated Press reported that President Obama has deported fewer immigrants with criminal convictions in the United States over the past 12 months than he has during his entire time in the White House. Moreover, the number of total illegal immigrants deported in the last year was less than at any time since 2006.
The total count of immigrant deportations has sunk 42 percent since 2012. Moreover, deportations declined by 84,000 between the 2014 and 2015 fiscal years.

The Border Patrol should be about protecting the border, not being politically correct.

Border Patrol agents and others operating under the umbrella of Customs and Border Protection (CBP) must now consider not only the sex of the criminal they are detaining, but the “gender identity” of the individual and how they feel and identify. The terms “illegal alien” or even “illegal immigrant” do not appear at all in a new 31-page instruction document. The new rules were published by CBP and according to the agency, “includes language on gender identity, which was not previously included in the individual component policies. Specifically, whenever feasible, officers and agents who conduct a search or are present at a medical examination must be of the same gender, gender identity, or declared gender as the individual being searched.”

Bernie Sanders: Let's give illegal immigrants Obamacare...

Democratic presidential candidate Bernie Sanders supports allowing some of the nation’s undocumented immigrants to obtain health-care coverage under the Affordable Care Act, he told Democratic lawmakers on Thursday.
The Vermont senator, who is running a competitive race against Democratic presidential front-runner Hillary Rodham Clinton, made the comments during a 45-minute meeting with members of the Congressional Hispanic Caucus, according to attendees. The 26-member group is comprised entirely of House and Senate Democrats.
Aides later said that Sanders believes that in certain cases, undocumented immigrants should be able to purchase health insurance through the exchanges set up under Obamacare, using their own money. The senator has not advocated allowing the undocumented immigrants to receive federal subsidies, his aides said.

The businessman’s statement made on a call with Alabama Republicans Thursday night added a bit of specificity to the Republican presidential frontrunner’s hardline stance on immigration. Mr. Trump released a six-page policy paper on immigration last month, and reporters have asked for details about how it would work since.
The Alabama Republican Party hosted the dial-in call with Mr. Trump Thursday night as part of series with the 2016 presidential candidates. Ben Carson, Jeb Bush, Carly Fiorina and Texas Sen. Ted Cruz have also participated.
On the call, Mr. Trump was asked for details about how long it would take to round up illegal immigrants living in the U.S., with the questioner asking if five or ten years was an appropriate timeframe. Mr. Trump said his two year benchmark could be met with “really good management.”

62% of illegal immigrant households receive welfare...

More than half of households headed by immigrants in the county illegally, or 62 percent, received welfare benefits in 2012, according to a report released by the Center for Immigration Studies.
In the same time period, 49 percent of households headed by legal immigrants received welfare benefits, while 30 percent of households headed by natives received the same.
The report evaluates data from the Census Bureau and found that illegal immigrant households benefit mostly from food programs like food stamps and Medicaid through their native-born children.
“Welfare use by illegal immigrant households is certainly a concern, but the bigger issue is welfare use by legal immigrants,” said Steven Camarota, the Center’s director of research and author of the report. “Three-fourths of immigrant households using welfare are headed by legal immigrants.”

Does this mean 20% of all illegals in this country have criminal records?

All told, 91,000 criminal aliens caught by the Border Patrol were deported last year, he said, compared to about 486,000 total illegal immigrants caught — a ratio of about 1 in 5. Nearly half of the criminal aliens deported had aggravated felonies on their records, Mr. Judd said.
Some Democrats blamed border violence on U.S. gun laws, saying that Mexico’s laws are strict, but Mexican cartels are able to get high-powered weapons from the U.S. and smuggle them south.

Pressed on what he'd do if the immigrants in question had nowhere to return to, Trump reiterated: "They have to go."

"We will work with them. They have to go. Chuck, we either have a country, or we don't have a country," he said.

Speaking on Trump's gilded private plane as it idled on a runway in Des Moines, Iowa, the real-estate mogul and Republican presidential frontrunner offered the first outlines of the immigration policy proposals he'd implement from the Oval Office.

Trump Plan: Charge Mexico $100,000 for every illegal immigrant who crosses the southern border.

Donald Trump has won over Republican voters with a pair of speeches to the party faithful, attacking the government of Mexico and outlining a plan to charge them $100,000 for every illegal immigrant who crosses the southern border.

The Republican presidential front-runner got round after round of applause at successive events in Las Vegas, Nevada and Phoenix, Arizona, at which he rounded on the Mexican government for allegedly ‘pushing’ undocumented immigrants to the U.S. to avoid dealing with them themselves.

Trump said that Mexico had been allowed to get away with the scheme because they are ‘smart’ and President Obama and his administration are ‘stupid’ – a situation which can only be fixed if he leads the charge to ‘take back our country’.
