Miami Herald finally runs 'Presidential Eligibility' story...about Marco Rubio


It's nice to see the mainstream media take an interest in the Constitution. /sarc

“It’s nothing to do with him personally. But you can’t change the rules because you like a certain person. Then you have no rules,” said New Jersey lawyer Mario Apuzzo.

Forget about the alleged Photoshopped birth certificates; the activists are not challenging whether Rubio was born in Miami. Rather, they say Rubio is ineligible under Article 2 of the Constitution which says “no person except a natural born citizen … shall be eligible to the Office of President.”

The rub is that “natural born citizen” was never defined.

The birthers rely on writings at the time of the formation of the republic and references in court cases since then to contend that “natural born” means a person born to U.S. citizens. Rubio was born in 1971 at Cedars of Lebanon Hospital, his office said, but his parents did not become citizens until 1975.

“Marco Rubio was born a Cuban citizen via his parents,” screams a headline on a blog by birther Charles Kerchner, who obtained copies of the naturalization petitions by Rubio’s parents in May, igniting talk that is spreading across the Web.

Kerchner said Rubio is no different from Obama, who even though he was born in Hawaii (which he doubts), was not born to two U.S. citizens. Obama’s father was a Kenyan national. The birthers say Louisiana Gov. Bobby Jindal, whose parents are from India and were not citizens at the time of his birth, is also unqualified. [...]

“The arguments aren’t crazy,” said Georgetown law professor Lawrence Solum, an expert in constitutional theory. But, he added, “the much stronger argument suggests that if you were born on American soil that you would be considered a natural born citizen.” Keep on reading...

Liberals are Getting Nervous. PBS Liberal Calls for Repeal of "Natural Born" Constitutional Requirement!

Donal Trump has really rattled the liberal mainstream media. They are staring to call for repeal of the "natural born" clause of the Constitution. Amending the Constitution is a very difficult and time consuming process. It would be much simpler for them to call on Barack Obama to release all his records and put the issue to bed. Liberals aren't following that strategy because they fear "birthers" are right and Obama isn't Constitutionally qualified to be President.

PBS' Jon Meacham claims we should allow the children of immigrants to run for President. Barack Obama's father wasn't an immigrant. He was a foreign national living in this country while pursuing an education. The Constitution did not define "natural born." Most historic definitions of "natural born" require birth on this soil from citizen parents. Obama can never meet that requirement. His father was a Kenyan citizen and British subject. The U.S. Federal Courts need to define "natural born" more clearly, but they won't consider Obama's eligibility. No court has ever ruled Barack Obama is eligible to be President. Instead, courts are dismissing the cases on  grounds of "lack of standing" because no harm was done to the plaintiff by Obama being elected President. They even dismissed a case where Presidential candidate Allen Keyes was a party. Apparently, the court didn't think he had a chance to win even if Obama was disqualified. Under the severe "standing" definition federal courts are now using for lawsuits relating to Obama's eligibility, John McCain may be the only person in the country who would meet their definition. McCain's "natural born" status has also been questioned (born in Panama Canal Zone) and he will never file a lawsuit.

Update: A commenter over at American Thinker made an interesting observation. When Jon Meacham advocated repealing the NBC clause so children of immigrants can run for President, he admitted that just being born on US soil isn't enough to make someone a natural born citizen. Barack Obama isn't a NBC by this reasoning because his father wasn't a U.S. citizen. Meacham must be very rattled to have let that slip out.

Oh My! Arizona Likely Will Pass a Law Requiring Candidates to Show Proof of Natural Born Citizenship!

The proposal would require "documents that prove that the candidate is a natural born citizen and meets residency requirements for President of the United States as prescribed in article II, section 1, Constitution of the United States." I seriously doubt the electronically generated COLB President Obama presented online and to FactCheck.com will suffice. He will likely need to submit his original birth papers. Considering the extent president Obama has gone to hide this document, and his other records, will he submit them or drop out of the 2012 race? The law still has to pass in Arizona, but it looks like the support may be there.

(WND)- A plan in Arizona to require presidential candidates to prove their eligibility to occupy the Oval Office is approaching critical mass, even though it has just been introduced.

The proposal from state Rep. Judy Burges, who carried a similar plan that fell short last year only because of political maneuvering, was introduced yesterday with 16 members of the state Senate as co-sponsors.

It needs only 16 votes in the Senate to pass.

In the House, there are 25 co-sponsors, with the need for only 31 votes for passage, and Burges told WND that there were several chamber members who confirmed they support theplanand will vote for it, but simply didn’t wish to be listed as co-sponsors.
