Strange: Obama's lawyer asks Florida judge to throw out eligibility challenge because he isn't the Democrat's nominee

Only a lawyer would be stupid enough to argue Barack Obama isn't the Democrats presidential nominee in 2012. Why doesn't he just argue Obama is a natural born citizen and therefore eligible?

WASHINGTON, Monday, June 18, 2012 — A lawyer for President Barack Obama argued today in Florida that a lawsuit claiming his client "is not eligible to appear on the November ballot because he is not a 'natural born citizen,'” should be dismissed on the grounds that the Democratic Party has not yet nominated a candidate.

In Tallahasse, Florida, Attorney Mark Herron, representing President Obama, told Leon County, Florida Circuit Judge Terry Lewis that the January 31, 2012 Florida Presidential Preference Primary “did not result in nomination or election” and that “federal law precludes this court from determining whether a candidate for the office of President of the United States is qualified under Article Two Section Five of the United States Constitution.”

 “There has been no nomination to office, there has been no election to office,” Herron told Judge Lewis.

Sheriff Joe Arpaio on investigation into Obama's social security number: " there could be a shock there somewhere that my guys came up with"

Arizona  Maricopa County Sheriff Joe Arpaio has convened a posse to investigate allegations President Obama is using a fraudulent social security number and forged birth certificate. He is playing his cards close to the vest, but he has strongly hinted there is a problem with the social security number.

Tuesday night, speaking to a tea-party group in Arizona, Arpaio said, "I can't tell you everything, but there could be a shock there somewhere that my guys came up with. I can't talk too much about it. It's in the process."...

The posse, assembled under the authority of Arpaio's office, consists of three former law enforcement officers and two retired attorneys with law enforcement experience. Members have been examining evidence since September concerning Obama's eligibility to be president under Article 2, Section 1 of the Constitution, which requires a president to be a natural-born citizen.

He referenced disputes over the Social Security number attributed to the president and said, "There are a couple of things you and nobody else here knows anything about yet that could be a little bit exciting."

WND and others have claimed proof that President Obama's social security number was issued in Connecticut when Barry Obama was a teenager living in Hawaii. Also, President Obama's social security number is flagged when entered into the new E-Verify system.

Many think President Obama's decision to release his long form birth certificate after refusing for three years is because of fear of this book. In the book, Jerome Corsi makes the case Barack Obama is not eligible to be president.

(ABC)- President Obama’s 2012 presidential campaign today started selling “Made in the USA” t-shirts featuring images of both President Obama and the long-form birth certificate he released copies of last month...

Part of the reason for the shirts, a campaign official told ABC News, is that despite the president’s release last month of his long-form birth certificate, conservative fact-challenged author Jerome Corsi’s book “Where's the Birth Certificate?: The Case that Barack Obama is not Eligible to be President” was published this week.

When citizens ask to see President Obama's vault copy long form birth certificate, Obama supporters and the mainstream media get outraged and accuse them of being racists. They have labeled citizens, who are concerned about the Constitution being followed, the derisive name of "Birthers". The mainstream media would lead you believe nobody would challenge the eligibility or birth certificate of a white candidate or President. Those allegations are factually incorrect. 2008 GOP Presidential Candidate John McCain's eligibility was called into question by none other than the "birthers" at the New York Times. They ran multiple stories about McCain's potential lack of natural born citizen status.

Mr. McCain’s likely nomination as the Republican candidate for president and the happenstance of his birth in the Panama Canal Zone in 1936 are reviving a musty debate that has surfaced periodically since the founders first set quill to parchment and declared that only a “natural-born citizen” can hold the nation’s highest office.

The Senate considered the issue worthy of a vote declaring John McCain is eligible to be President. Senator Barack Obama co-sponsored the resolution.

See how easy that was President Obama? Incidentally, McCain's short form was also released, but it lacked information such as the hospital McCain was born in. Obama's short form has the same deficiencies. 

 Were the people who questioned McCain's eligibility reverse racists? Where was the media outrage? Why is there a double standard?

Liberals are Getting Nervous. PBS Liberal Calls for Repeal of "Natural Born" Constitutional Requirement!

Donal Trump has really rattled the liberal mainstream media. They are staring to call for repeal of the "natural born" clause of the Constitution. Amending the Constitution is a very difficult and time consuming process. It would be much simpler for them to call on Barack Obama to release all his records and put the issue to bed. Liberals aren't following that strategy because they fear "birthers" are right and Obama isn't Constitutionally qualified to be President.

PBS' Jon Meacham claims we should allow the children of immigrants to run for President. Barack Obama's father wasn't an immigrant. He was a foreign national living in this country while pursuing an education. The Constitution did not define "natural born." Most historic definitions of "natural born" require birth on this soil from citizen parents. Obama can never meet that requirement. His father was a Kenyan citizen and British subject. The U.S. Federal Courts need to define "natural born" more clearly, but they won't consider Obama's eligibility. No court has ever ruled Barack Obama is eligible to be President. Instead, courts are dismissing the cases on  grounds of "lack of standing" because no harm was done to the plaintiff by Obama being elected President. They even dismissed a case where Presidential candidate Allen Keyes was a party. Apparently, the court didn't think he had a chance to win even if Obama was disqualified. Under the severe "standing" definition federal courts are now using for lawsuits relating to Obama's eligibility, John McCain may be the only person in the country who would meet their definition. McCain's "natural born" status has also been questioned (born in Panama Canal Zone) and he will never file a lawsuit.

Update: A commenter over at American Thinker made an interesting observation. When Jon Meacham advocated repealing the NBC clause so children of immigrants can run for President, he admitted that just being born on US soil isn't enough to make someone a natural born citizen. Barack Obama isn't a NBC by this reasoning because his father wasn't a U.S. citizen. Meacham must be very rattled to have let that slip out.

Arizona "Birther" Bill Ready For Jan Brewer's Signature

The Arizona legislator has passed a bill requiring candidates to prove eligibility. This will be the first such law in the nation, but several other states are considering legislation. Will GOP Gov. Jan Brewer sign it into law? I believe she will. President Obama hasn't done her or Arizona any favors lately.

PHOENIX (AP) -- The Arizona Legislature gave final approval late Thursday night to a proposal that would require President Barack Obama and other presidential candidates to prove they are U.S. citizens before their names can appear on the state's ballot.

Arizona would become the first state to require such proof if Gov. Jan Brewer signs the measure into law.

President Obama could end this circus today if he was willing. Of course, the media and Obama apologists claim he has submitted the short form of his birth certificate and that is all Hawaii will issue now. CNN's Jon Klein went so far as to say CNN researched the issue and Hawaii destroyed all the old records after making electronic versions. Both these claims are utterly and completely false. You can see a copy of a long form birth certificate issued by the state of Hawaii in March 2011 of this year here. Need more proof? Here is a video shot in Honolulu, HI in mid-July 2010. A woman orders her long form birth certificate because the short certificate of live birth doesn't have the same information on it. It cost her a measly ten dollars.

Real journalism has died an ugly death because the media's desire to provide cover for Barack Obama. I can still remember when the mainstream media was so eager to investigate President Bush's time, as a young man, in the Texas Air National Guard, they used "fake, but accurate" documents in a 60 Minutes segment. President Obama spent from one month to one year (we really don't know how long) in Pakistan or Afghanistan when he was a young man. Strangely, the media could care less how a poor college student could afford such an expensive trip or what young Obama Barry did while he was there. My how the times have changed.

Sara Palin: There is something on Obama's birth certificate he doesn't want people to see

“I think he was born in Hawaii because there was the birth announcement put in the newspaper. But there’s something there that the president doesn’t want people to see on that birth certificate. Then he seems to go to great lengths to make sure it is not shown.”

If we apply Occam's razor, the simplest explanation for why President Obama won't show his long form birth certificate is Barack Obama Jr. doesn't have one on file in Hawaii. That could mean he was born in Kenya or Canada or somewhere else, but I agree with Sarah Palin and  think that is unlikely based on the newspaper announcements. A more plausible explanation wold be his stepfather, Indonesian Lolo Soetoro, adopted him. His original long for birth certificate would then be sealed under court order and replaced by one that says he is the son of Lolo Soetoro. Obama may not want to remind voters he was once a little Indonesian boy named Barry Soetoro. This explanation also explains why he won't release his college records and why his social security number is fishy. As an adopted Indonesian citizen, Obama may have entered Occidental College as a foreign student. Foreign students get special social security numbers that start with 999. When Barry decided to re-assume his birth name of Barack Obama Jr, he needed a new social security number. Once you get a social security number you are stuck with it for life. Obama may have assumed a social security number from a deceased person or took a number that has never been issued. Illegal immigrants do it all the time. Many people try to explain Obama's refusal to release his birth and college records as an opportunity for him to "thumb his nose" at his political opponents. I don't buy the "thumbing his nose" at voters theory. As closely divided as the electorate has been in recent years, remember the presidential election of 2000, nobody running for office would want this cloud hanging over their head and putting doubt in the minds of voters. This is like a 'bugger' hanging from Obama's nose that he won't flick. The simplest explanation is he can't without catastrophic damage to his credibility and image.

An alleged WH insider has been sending email with what appears to be inside information on the Barack Obama administration. This person has accurately predicted Summers, Emanuel and Gibbs would leave the administration long before anyone else. The WH insider claims Obama is clueless about Egypt and the administration is spending a lot of time preparing for a Supreme Court challenge of Obamacare. Also, the "birther" eligibility issue has the White House nervous. They are afraid several state will require Obama to prove his eligibility and natural born status. ABC News/WaPo Poll Shocker: 1 In 7 Democrats Are "Birthers"

An ABC News/Washington Post poll released yesterday had a shocking result. Fifteen percent (15%) of Democrats think President Obama may have been born in a foreign country. Eighteen percent (18%) of Independents and thirty-one (31%) of Republicans believe Obama may have been born abroad. There is a constitutional requirement that Presidents be "natural born" citizens. President Obama has released a "short form" computer generated birth certificate to Factcheck.org, but detractors want to see his original "long form" birth certificate because it contains more information; such as the Doctor's name and Hospital of birth. The State of Hawaii has issued a statement attesting to Barack Obama's Hawaiian birth. For some unknown reason, President Obama has refused to clear up American's lingering confusion about his birth by asking Hawaii to release his "long form" original birth certificate. It is strange Obama would allow 15% of his core constituency and 18% of Independents to think his presidency is unconstitutional. Hmm...15% of Dems, 12% of Liberals Are Birthers

I wonder why President Obama doesn't clear this issue up by requesting Hawaii release his long-form birth certificate? As long as "birthers" are only his political opponents, it might make sense to keep them confused. However, when a significant portion of his core supporters question his legitimacy, it makes no political sense to keep the issue of his birth in doubt.

The Washington Times reported:

Fourteen percent of Americans say without prompting that they think Barack Obama was born in another country, rising to one in five when those with no opinion are offered that as a possibility. But for many it’s not a firm belief – and some appear not to hold it against him....

….At the same time, 15 percent of Democrats say they think Obama was born elsewhere, as do 12 percent of liberals...

Video: Justice Clarence Thomas admits Supreme Court Evading Eligibility Issue

The excerpt and video are from a House subcommittee hearing Thursday. The exchange is between Subcommittee Chairman Rep. Jose Serrano (D-NY) and U.S. Supreme Court Justice Clarence Thomas. Thomas seems to admit the Supreme Court is evading the eligibility issue. There is nervous laughter from the crowd.

"I'm still waiting for the [court decision] on whether or not a Puerto Rican can run for president of the United States," said Serrano...

"Oh really?" asked Serrano. "So you haven't answered the one about whether I can serve as president, but you answer this one?"

"We're evading that one," answered Thomas, referring to questions of presidential eligibility and prompting laughter in the chamber. "We're giving you another option."

67% of AOL Online Poll Support Obama Eligibility Question

This AOL poll is an online poll and not a scientific sample. The most surprising thing is the poll is embedded in a left-wing, eligibility question ridiculing article. The article quotes Daily Kos and Little Green Footballs. The term "political cynicism mixed with blinding stupidity" is quoted. It is amazing that, in spite of this being a fringe left wing article, 67% of the readers who made it to the poll embedded halfway down the page think Obama's eligibility is a serious question.

Are Nancy Pelosi and the DNC "birthers"?

A commentator at Canada Free Press claims to have possession of two different versions of the document democrats used to register Barack Obama as their Presidential candidate. The first version has language certifying Barack Obama and Joe Biden are "legally qualified to serve under the provisions of the United States Constitution." The second document, which the DNC actually used, has this language removed. Both documents appear to be signed by Nancy Pelosi and notarized on the same day.

When contacted and asked about the first version, the DNC would only say "We are aware of it." Nancy Pelosi has refused comment so far.

The Certification of nomination the Republicans used clearly had "eligibility " language. You can see that document here.

If the first version is authentic, Nancy Pelosi and the DNC may have had serious doubts about Barack Obama's constitutional eligibility to serve and were unwilling to sign their names to a document certifying he meet Constitutional requirements. Others have suggested there were just different versions because some states may have different requirements. It is unclear why the document with the eligibility language wouldn't be sent to all states even if they didn't require it. Both the documents contain the same typo. The word "though" is substituted for the word "through." Spell check won't find this typo. The typo indicates both copies are different edits of the same document.

"Birthers" win one?

Attorney Orly Taitz appears to have won a small victory in court today. California U.S. District Judge David Carter has tentatively scheduled a trial for January 26, 2010. This is the first time a judge has agreed to hear the case against Barack Obama's eligibility on it's merits. There is still a hurdle in the way. At the last minute, the Justice department filled a motion for dismissal based on more technicalities. The Justice Department is arguing the defendants haven't been harmed. One of the defendants is former Presidential candidate Alan Keyes. The Justice Department is arguing Keyes was not harmed because he wasn't on enough state ballots to have a mathematical chance of winning. There will be a hearing on the Justice Departments motion to dismiss on Oct. 5, 2009. If the case is not dismissed at that hearing, a pretrial hearing has been scheduled for Jan. 11, 2010 and the trial starts January 26, 2010. On the important issue of "discovery," the judge ordered arguments be submitted. Among the evidence Taitz filed is this purported copy of Barack Obama's Kenyan birth certificate. The man in possession of this document, Lucas Smith, has filed a sworn affidavit in Judge Carter's court that the document is authentic. Smith claims he obtained the alleged birth certificate from Coast General Hospital in Mombasa, Kenya, by bribery, and insists it's real. It should be noted Smith tried to sell this document on eBay and has a shady past.

Guess what? So called 'birthers" are not a fringe group.

According to a Kos/Research2000 poll published on Politico, only 42% of Republicans and 83% of Independents are sure Obama was born in the USA. Even 7% of democrats are unsure. Americans who want Obama to prove his eligibility can not be called a fringe group anymore. Twenty-three percent(23%) of Americans is not a fringe group.

Updated: Weird Things are Happening in the Obama Birth Certificate Saga

Several military personnel have engaged in a lawsuit claiming President Obama's orders are not valid because he has not proven his eligibility for office. U.S. Army Reserve Maj. Stefan Frederick Cook was threatening to defy a July 16th order to deploy to Afghanistan. You might think this would lead to a court marshal where both sides would present their case. The Government should be able to easily prove Obama was born in Hawaii and eligible. Right? The Army has chosen a very different path. They abruptly and with out comment canceled Maj. Cook's deployment order.

A U.S. Army Reserve major from Florida scheduled to report for deployment to Afghanistan within days has had his military orders revoked after arguing he should not be required to serve under a president who has not proven his eligibility for office.

His attorney, Orly Taitz, confirmed to WND the military has rescinded his impending deployment orders.

"We won! We won before we even arrived," she said with excitement. "It means that the military has nothing to show for Obama. It means that the military has directly responded by saying Obama is illegitimate – and they cannot fight it. Therefore, they are revoking the order!"

She continued, "They just said, 'Order revoked.' No explanation. No reasons – just revoked."

Then, the Department of Defense compelled his private employer, a defense contractor, to fire him.

The Department of Defense has compelled a private employer
to fire a U.S. Army Reserve major from his civilian job after he had his military deployment orders revoked for arguing he should not be required to serve under a president who has not proven his eligibility for office.

According to the CEO of Simtech Inc., a private company
contracted by the Defense Security Services, an agency of the Department of Defense, the federal government
has compelled the termination of Maj. Stefan Frederick Cook.

Update: This morning a federal judge dismissed the suit filed by a U.S. Army reservist who demanded proof Obama was eligible to be Commander-in-Chief before he would agree to be deployed to Afghanistan. The military successfully argued the case was "moot" because Major Cook's deployment was canceled. Am I the only one sensing a plan by Obama?

Judge Clay Land sided with the defense, which claimed in its response to Maj. Stefan Frederick Cook's suit, filed July 8 with the U.S. District Court for the Middle District of Georgia, that Cook’s suit is “moot” in that he already has been told he doesn’t have to go to Afghanistan, so the relief he is seeking has been granted.
