Bye Bye Stupak. Don't Let the Door Hit You in the Butt on the Way Out.


Michigan Rep. Bart Stupak (D-gullible) has decided to not run for re-election in 2010. Stupak has received criticism from both sides for his abortion position during passage of Obamacare. Liberals were angered at his demands for additional provisions to prevent federal funding of abortion. Pro-life advocates were angered when Stupak caved and accepted a meaningless Executive Order from President Obama in lieu of stronger antiabortion language in the health care reform bill. Conservatives, Pro-life advocates, Republicans and the Tea Party have targeted Rep. Stupak for defeat this November.

Michigan Democratic Rep. Bart Stupak, who was the central figure in the abortion debate surrounding the health care law, will retire from Congress at the end of this term.

‘Stupak 11′ Request $3.4 Billion in Earmarks. Is This a Payoff?



The ‘Stupak 11′ requested $3.4 billion in earmarks the next day after their crucial vote to allow the government to take over our health care. Undoubtedly, this request will be looked on favorably by the Democratic leadership in Congress. I have no proof this is a 'Quid Pro Quo,' but it stinks to high heaven.

A day after Rep. Bart Stupak, D-Mich., and ten other House members compromised on their pro-life position to deliver the necessary yes-votes to pass health care reform, the “Stupak 11″ released their fiscal year 2011 earmark requests, which total more than $3.4 billion...

Stupak requested more than $578 million in earmarks, including $125 million for a replacement lock on the Sault Ste. Marie, $25.6 million to build a federal courthouse in Marquette, Mich., $15 million to repaint the Mackinac Bridge and $800,000 to preserve the Quincy Mining Company smelter near Hancock in Michigan’s Upper Peninsula.

Obvious: Michigan Right To Life Boots Stupak


No surprise here:
On Wednesday, March 24, the Right to Life of Michigan political action committee notified U.S. Representative Bart Stupak that his endorsement was rescinded.

In a letter sent to Representative Stupak, the RLM-PAC qualified how the endorsement criteria was no longer met...

On March 21, Representative Stupak failed to meet those requirements by voting for President Barack Obama's health care bill, H.R. 3590.

Hmm...Obama Hasn't Signed The Executive Order He Negotiated With Stupak



Obama hasn't yet signed the Executive Order he negotiated with Rep. Bart Stupak. Perhaps he will quietly sign it later this week when his liberal supporters are distracted and looking the other way. Wouldn't it be interesting if Obama double-crossed Stupak?
President Obama signed the Senate health care bill into law Tuesday. He did not sign the executive order on abortion negotiated with Michigan Democratic Congressman Bart Stupak in an 11th-hour arrangement that may well have saved the entire health care reform effort.

A White House official told Fox, Obama will not sign the Executive Order Tuesday and has set no specific date to do so....

Stupak Parties With Demo Buddies After Selling Out His Constituents


Nothing like tossing down some brews after selling your morality and constituents out. Roll Call is reporting Rep. Bart Stupak partied with his Democrat buddies into the wee hours of the morning after caving in on his demands stronger anti-abortion language be added to the Democrats health care bill. Reportedly, Rep. Anthony Weiner (D-N.Y.)kissed Stupak’s cheek. I wonder if a tickle fight broke out afterwords?
What better way to celebrate passing history-making legislation than kicking back at a dive bar famous for its cheap beer and taxidermy-heavy décor?

A large group of House Democrats defied cigar-and-champagne stereotypes....

An HOH spy says Rep. Anthony Weiner (D-N.Y.) planted a giant kiss on Stupak’s cheek.

Stupak Stripped of "Defender of Life" award


It has begun.

FOX News reported:
Susan B. Anthony List Candidate Fund President Marjorie Dannenfelser said the group was revoking its "Defender of Life" award to Stupak, which was to be awarded at its Wednesday night gala.

"We were planning to honor Congressman Stupak for his efforts to keep abortion-funding out of health care reform. We will no longer be doing so," Dannenfelser said. "Let me be clear: any representative, including Rep. Stupak, who votes for this health care bill can no longer call themselves 'pro-life.'"

Bart Stupak angered his liberal constituents long ago and earned himself a primary cahallenger. Now, he has angered his conservative and pro-life constituents. It is hard to see who his constituent base will be this fall. There are a large number of Independents, but they are notoriously fickle and over 60% opposed the Democrat's health care reform bill. What in the world could Rep. Stupak have been thinking?

The Hill is reporting there are 39 Democrats voting no. Democrats can only afford 37 defections and reach the 216 yes vote number they need for passage. There are conflicting reports Stupak will cave for a useless Executive Order or something. The latest report is there is still no deal, but don't be shocked to Stupak 'heel' and accept some kind of face saving token from President Obama.

Report: No Stupak Abortion Deal


Nancy Pelosi appears to have nixed any possibility of a vote on stronger anti-abortion measures demanded by Rep. Stupak and crew. Pelosi is planning to "go for it' without them. This probably means she would have lost the support of more liberals by allowing an anti-abortion vote than she would have gained by picking up a few more "Blue dogs."
Two pro-life GOP members close to Stupak tell NRO that any Stupak deals are off. They just spoke with him and they said he's finished with Pelosi. They rejected his enrollment corrections proposal.

He's finished with Pelosi? Welcome to the club Rep. Dtupak. What took you so long to realize what the vast majority of Americans realized months ago?

Stupak believes House Democrat leaders at least 16 votes short on healthcare reform


Hmm.. I hope Rep. Stupak is correct.

The Hill reported:
Rep. Bart Stupak (D-Mich.) said Monday he thinks House Democratic leaders are not close to having the votes to pass health reform.

In an interview with Fox News' Greta Van Susteren, the anti-abortion rights lawmaker said, "I'd be surprised if they have 200 votes."

House Democratic leaders need 216 to pass the bill.

Stupak noted that he is not counting votes with Speaker Nancy Pelosi (D-Calif.) and her lieutenants, calling his figure "a guesstimate."

Waxman To Stupak: “we want to pay for abortions,”

Democrats seem to have given up on adding abortion restrictions to the Senate version of Obamacare. Apparently, they really didn't want to do this anyway. Bart Stupak (D - MI) has revealed Henry Waxman confessed, Democrats want to federally fund abortion.

That’s one of the arguments I’ve been hearing,” Stupak says. “Money is their hang-up. Is this how we now value life in America? If money is the issue — come on, we can find room in the budget. This is life we’re talking about.”

It’d be like Ron Paul claiming that pro-war Republicans told him to vote for Iraq because they were dying to get their hands on all that oil.

Stupak Claims he hasn't caved


After hints a compromise on abortion was in the works, Rep. Stupak claims,
“Everyone’s going around saying there’s a compromise—there’s no such thing,”

The Weekly Standard reported:

“Members don’t have a whole lot of appetite to vote for the Senate bill as a stand alone bill–that’s for sure,” Stupak said...

Stupak Prepares to Fold?


The best hope of stopping Obamacare is Rep. Bart Stupak and other blue dog democrats who are opposed to abortion coverage in the Senate bill version of Obamacare. Unfortunately, Stupak is signaling he may be ready to cave in.
Rep. Bart Stupak said he expects to resume talks with House leaders this week in a quest for wording that would impose no new limits on abortion rights but also would not allow use of federal money for the procedure.

“I’m more optimistic than I was a week ago,” Stupak said in an interview between meetings with constituents in his northern Michigan district. He was hosting a town hall meeting Monday night at a local high school.

“The president says he doesn’t want to expand or restrict current law (on abortion). Neither do I,” Stupak said. “That’s never been our position. So is there some language that we can agree on that hits both points — we don’t restrict, we don’t expand abortion rights? I think we can get there.

Abortion Funding is Derailing Obamacare


Rep. Bart Stupak (D-Mich.) and socially conservative Democrats forced Nancy Pelosi to put strong antiabortion funding language in the House version of Obamacare. The Senate version does not contain that language and Stupak and at least 12 other Democrats are telling Pelosi they will not vote for the Senate version without language to prohibit forced funding of abortion.
“It’s accurate to say there are at least 12 of us who voted for healthcare that have indicated to the speaker and others that unless you change this language, we will vote against it,” Stupak said during an appearance on MSNBC. …

The congressman’s comments come on the heels of his claims last week, when he said he knows of 15-20 Democratic lawmakers who are witholding support for the bill because of “other problems.” But it is not clear if or how many overlap between the two groups.

Pelosi must first pass the Senate version of Obamacare for their 'reconciliation' dreams to come true. Then, the plan is to make changes desired by the House to the Senate version by the reconciliation process. Of course, after the House passes the Senate version, President Obama can sign it into law without any additional changes. President Obama and Harry Reid oppose adding language to prevent federal funding of abortion to the bill. There is no guarantee the changes the House want would ever get passed. The Senate could fail to pursue the changes aggressively or Republicans could block them. How is Nancy Pelosi responding to this conundrum? She lying through her teeth. She denies there is funding for abortion in the Senate version Obamacare and tries to pretend it is even a big issue.
Speaker Nancy Pelosi got exasperated when asked at her weekly news conference about the unwillingness of some Democrats – including Rep. Bart Stupak (D-Mich.) – to support the health bill because of abortion language.

“Let me say this: This is not about abortion! This is a bill about providing quality, affordable health care for all Americans,”
she said, more eager than ever to stay on message as her legacy becomes increasingly tied to what happens in the next few weeks....

“I will not have it turned into a debate on (abortion),” she said, when asked a follow-up question about Stupak. “Let me say it clearly: we all agree on the three following things. … One is there is no federal funding for abortion. That is the law of the land. It is not changed in this bill. There is no change in the access to abortion. No more or no less: It is abortion neutral in terms of access or diminution of access. And, third, we want to pass a health care bill.”

Rep. Bart Stupak (D-Mich.) is politely calling Pelosi a liar when she claims the Senate health care reform bill doesn't force taxpayers to fund abortion.
Stupak also fired back at Speaker Nancy Pelosi, disputing her claims at a news conference three hours earlier that the Senate health bill won't allow federal funding for abortion.

"She's incorrect," he said. "I'd ask the speaker to direct her attention to page 2069 through page 2078. There are two ways in those pages where you pay for abortion. Number one, you get tax breaks that subsidize your insurance policy that will pay for abortion. Number two, when you read the legislation, one dollar per month for all enrollees, must go into this fund for 'reproductive care,' which includes abortion coverage."

Stupak Anti-Abortion Amendment Has A Huge Loophole

Nancy Pelosi managed to gather enough votes to pass the almost 2000 page House health care reform bill (H.R.3962) by allowing the Stupak Amendment. Many blue dog Democrats would not vote for Pelosicare because because it covered abortion with health care reform funds.

According to the New York Times:
To save the health care bill she (Pelosi) had to give in to abortion opponents in her party and allow them to propose tight restrictions barring any insurance plan that is purchased with government subsidies from covering abortions.

How tight are these restrictions? Here is a screen shot from a pdf of the Stupak Amendment.

The Amendment says no funds may be used to fund abortion or any health care plan that includes abortion unless there is a physical disorder, physical injury or physical illness that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself, or unless the pregnancy is the result of an act of rape or incest.

This certainly sounds like a strong prohibition, except for the rape or incest clause. Usually Democrats try to leave a huge loophole by sticking in an exception for "mother's health." This could be interpreted to include mental health. Under the The Mental Health Parity Act most of the distinctions insurance companies can make between mental health and physical health have been removed. At first glance, this loophole seems to be be missing from the Stupak Amendment. That is until you look up the definition of "physical disorder." A physical disorder (as a medical term) is often used as a term in contrast to a mental disorder, in an attempt to differentiate medical disorders.

A physical disorder (as a medical term) is often used as a term in contrast to a mental disorder, in an attempt to differentiate medical disorders which have an available objective mechanical test (such as chemical tests or brain scans), from those disorders which have no objective laboratory or imaging test, and are diagnosed only by behavioral syndrome (such as those in the Diagnostic and Statistical Manual of Mental Disorders or DSM manual. Most familiarly, this is a term used as opposed to supposed "purely" mental disorders.

This looks like a back door to the old mental health abortion loophole when the "mother's health" term is used. Many people claim there is no distinction between physical and mental disorders. There is already a court ruling defining bipolar as a physical disorder and not a mental illness.
The Case: Fitts v. Fannie Mae[1]

The ruling by the United States District Court for the District of Columbia involves an employee of a major mortgage company who developed bipolar disorder and whose employee disability insurance provider stopped paying disability benefits after 24 months on the grounds of bipolar disorder being a ‘mental illness’. The policy provided cover until the age of 65 for physical disability. Ms. Fitts had worked for the company for 13 years before she was first diagnosed with bipolar disorder in 1995. The employee- Ms. Jane Fitts, successfully brought a case against both the employer and the insurer arguing that bipolar disorder did not clearly fall in the category “mental, emotional or nervous diseases or disorders of any type”. The court awarded “prejudgment interest on all sums due her and the costs of this action “.

Based on the language of the Stupak Amendment and the above court ruling, a suicidal woman diagnosed as bipolar could qualify for abortion funds under H.R.3962. Democrats only need to get a liberal judge to issue more court rulings defining depression and other mental health problems as physical disorders. Then, the abortion floodgate is open. This is a loophole you can run a herd of donkeys through. There is even the possibility the abortion restriction would be declared as unconstitutional even if abortion coverage doesn't get added back in later. Partial birth abortion laws have already been declared unconstitutional if they don't include the "mother's health" loophole.
