When the Supreme Court announced its decision Wednesday on whether a fisherman should be charged under Wall Street regulatory laws, Justice Elena Kagan decided to include an unusual judicial argument: Dr. Seuss.
In 2007 in Florida, law enforcement officials confronted fisherman John Yates, saying he had caught several red groupers that were too small. Mr. Yates then tossed the fish overboard. But he was charged under the Sarbanes-Oxley Act, which sought to punish the destruction of physical evidence in wake of the Enron scandal where accountants shredded thousands of documents.
In a 5-4 decision announced Wednesday, the Supreme Court ruled that the law was meant to apply only to records or information documents.

Blocked: Emails Solicitor General Elena Kagan sent from her DOJ email account to people in the White House


By any reasonable standard of judgement, Supreme Court Justice Elena Kagan should recuse herself from any Obamacare cases. Of course, she is unlikely to do this because it would doom President Obama's hopes of a favorable SCOTUS decision. Plan "B" is to hide her involvement in defending Obamacare as solicitor general and hope it flies under the radar.
(CNSNews.com) - U.S. District Judge Ellen Segal Huvelle, a Clinton appointee, has ruled that the Justice Department does not need to release emails Solicitor General Elena Kagan sent from her DOJ email account to people in the White House—in which she discussed her recusal decisions as solicitor general—because the emails were “used for a purely personal objective.”

CNSNews.com and Judicial Watch were seeking public release of the emails through lawsuits filed under the Freedom of Information Act.

The “purely personal objective” cited by the judge was Kagan’s goal of being confirmed to the United States Supreme Court.

At issue is whether Kagan must recuse herself as a Supreme Court Justice when the cases challenging the constitutionality of Obamacare reach the court.

SCOTUS Newest Liberal Votes to Stop Execution Because Execution Drug is Unsafe


You just can't make stuff like this up. President Obama's latest Supreme Court appointment, Elena Kagan, votes in dissent with liberals to stop an execution because the drugs used may be unsafe. Hmm... She must be afraid the drugs could actually kill the criminal being executed. Unbelievable.


The LA Times reported:
Washington…Justice Elena Kagan cast her first recorded vote on the Supreme Court late Tuesday, joining the liberals in dissent when the high court cleared the way for the execution of an Arizona murderer.

The 5-4 ruling overturned orders by a federal judge in Phoenix and the U.S. 9th Circuit Court of Appeals in San Francisco that had stopped the execution by lethal injection of Jeffrey Landrigan.

His lawyers, in a last-ditch appeal, had raised questions about one of the drugs used in the execution. Since the only U.S. manufacturer of sodium thiopental had suspended production, Arizona officials said they had obtained a supply of the drug from a British company.

A judge had put the execution on hold because she said she was "left to speculate" whether this drug was safe for its intended use.

Obama SCOTUS nominee Elena Kagan refused to say the Commerce Clause couldn't be used to force Americans to eat three servings of vegetables a day. Kagan appears to prefer waffles. It was an easy question if the answer was no.

Elena Kagan deliberately subverted scientific report to win partial-birth abortion approval

Elena Kagan deliberately subverted a scientific report by the American College of Obstetricians and Gynecologists (ACOG) to win partial-birth abortion approval. The Federal Court case involved Nebraska’s ban on partial-birth abortion in 2000. The ACOG put out what was billed as a non-partisan report that played heavily in the Courts decision to strike down the partial-birth abortion ban. The draft report from the ACOG contained the following statement that was very damaging to partial-birth abortion supporters.
"[A] select panel convened by ACOG could identify no circumstances under which [the partial-birth] procedure ... would be the only option to save the life or preserve the health of the woman."

The allegedly non-partisan ACOG shared this draft statement with the Clinton White House and Elena Kagan, then a deputy assistant to the president for domestic policy, freaked out and wrote her superiors this in a memo (pdf):
Todd Stern just discovered that the American College of Obstetricians and Gynecologists (ACOG) is thinking about issuing a statement (attached) that includes the following sentence: "[A] select panel convened by ACOG could identify no circumstances under which [the partial-birth] procedure ... would be the only option to save the life or preserve the health of the woman." This, of course, would be disaster -- not the less so (in fact, the more so) because ACOG continues to oppose the legislation. It is unclear whether ACOG will issue the statement; even if it does not, there is obviously a chance that the draft will become public.

Kagan had a solution. She drafted a suggested revision to the scientific report.

The suggest change reads:
"An intact D&X [the medical term for the procedure], however, may be the best or most appropriate procedure in a particular circumstance to save the life or preserve the health of a woman."

The supposedly non-partisan ACOG replaced their scientific opinion with Elena Kagan's political opinion verbatim in the final report.

This language was crucial in the Supreme Court's decision to overturn Nebraska's partial-birth abortion ban. Elena Kagan helped dupe the Supreme court with inaccurate and deceptive scientific information. She is unqualified to join that body.

I guess the joke from Minnesota has already made up his mind how he will vote on President Obama's SCOTUS nominee Elena Kagan. Minnesota Senator Al Franken was seen napping and doodling during a confirmation hearing. Of course, Kagen is being vague and disingenuous. She will not out herself as a far-left progressive activist jurist. Franken taking a nap may be the most noteworthy event that occurs during the hearings.

Obvious: Media Matters attacks Sean Hannity for not attacking Kagan



The liberals over at Media Matters must have been looking forward to an opportunity to slam Sean Hannity when he attacked President Obama's SCOTUS nominee Elena Kagan. The Hannity attack has so far failed to materialize. Media Matters fires a preemptive shot and attacks Hannity for not attacking Kagan. Huh?

We've noted that most right-wing media have been willing and eager to go back to the same well of discredited and false smears of Elena Kagan in their effort to take down her Supreme Court nomination.

But not Sean Hannity.

Yes, it appears that the case against Kagan is so weak that Hannity -- who basically uses his show to act as a GOP spokesman - isn't even going through the motions.

Tonight, on the first night of her confirmation hearings, Hannity mentioned Kagan in passing before turning to a discussion of the Supreme Court's ruling today on guns. According to a Nexis search, it was the first time her name had been spoken on his show in more than a month....

CBS Legal Correspondent Calls Obama's Failure To Embrace Kagan's Liberalism "Insulting"



Obama's SCOTUS nominee is against gun rights and favors partial-birth abortion. According to CBS Chief Legal Correspondent Jan Crawford, that makes Kagan a mainstream liberal and Obama should embrace those views.

NewsBusters reported:
"These documents have her squarely within mainstream liberal thought," Crawford said on the June 6 broadcast of CBS's "Face the Nation." "She's worried about the conservative Supreme Court undoing rulings that would give a woman a right to an abortion. She's worried about gun rights saying she's not sympathetic to an individual's right to own a handgun. She's concerned about conservative rulings scaling back rights of criminals. That's basic mainstream liberal thought."

However, Crawford noted the White House wasn't quick to embrace Kagan's liberalism and she gleaned one of two conclusions from that....

And this strategy by the White House - to conceal liberal thought is disappointing to Crawford, which she said was an insult to Justices Stephen Breyer and Ruth Bader Ginsburg.

Obama’s Supreme Court Nominee Elena Kagan Supported Partial-Birth Abortion


New documents have been uncovered showing Supreme Court nominee Elena Kagan supported partial-birth abortion by defending ex-President Bill Clinton’s veto of a bill to ban partial-birth abortions. Kagan is joined by only 17% of Americans who think partial-birth abortion should be legal. Even half of Americans who think abortion should be legal in all circumstances oppose partial-birth abortion.

Life News reported:
A newly-produced document today from the Clinton archives is the second to show Supreme Court nominee Elena Kagan defending ex-President Bill Clinton’s veto of a bill to ban partial-birth abortions. The memo, and others, may increase Republican opposition to her nomination.

In one of the documents that comprises the 46,000 pages of material the William J. Clinton Presidential Library released today, Kagan opined on the ban for Clinton as an attorney with the administration’s Office of Domestic Policy....

Leading pro-abortion groups like Planned Parenthood and NARAL made claims that flew in the face of medical practice ...

Fitzsimmons signed on to that mantra but eventually relented, saying he “lied through my teeth” about the statistics...

Voters Give SCOTUS Nominee Elena Kagan a Thumbs Down



After President Obama nominated Elena Kagan for the Supreme Court, only 39% of voters had an unfavorable opinion. Now, that percentage is up to 47%. Kagan has a logn way to go to become as unpopular as President Obama. 56% of voters disapprove of him.

Elena Kagan bemoaned the failure of socialism in Princeton Undergraduate Thesis


Many people think Barack Obama is a socialist. There is no reason to believe he wouldn't appoint like-minded people to his administration and even the Supreme Court. In an undergraduate thesis at Princeton, Obama's newest Supreme Court nominee, Elena Kagan, bemoaned the failure of socialism in America. At the time of this thesis, the Soviet Union was the dominant socialist country in the world.
Elena Kagan: "The story is a sad but after also a chastening one for those who, more than half a century socialism's decline, still wish to change America."

Elena Kagan Will Add New Diversity To Supreme Court


No. It's not what you are thinking. Elena Kagan will join two other liberals female Justices from New York on the Supreme Court. Brooklyn, Manhattan and the Bronx will be represented if Kagan is confirmed. Liberal New Yorkers are Taking over the Supreme Court.

Power Line reported:
If Elena Kagan is confirmed, as she is expected to be, the Supreme Court will contain three female Justices. And it will be a diverse group of women too -- one originally from Brooklyn, one originally from Manhattan, and one originally from the Bronx.
