Wisconsin Gov. Scott Walker (R) plans to sign two new laws on Wednesday that expand the rights of gun owners by removing a 48-hour waiting period for those looking to purchase a firearm and allowing off-duty or retired police officers to carry concealed weapons at public schools. This action will come one week after a suspected gunman shot and killed nine people in an African American church in South Carolina, yet again prompting a national discussion about gun laws in the U.S.
Walker plans to sign the two pieces of legislation — Senate bills 35 and 70 — at a ceremony at the Milwaukee County Sheriff’s Office on Wednesday afternoon, according to a Tuesday evening press release from the governor’s office. Laurel Patrick, a spokeswoman for the governor, said this bill-signing was scheduled and announced about two weeks ago, several days before the shooting occurred in South Carolina.

Poll: Support for gun rights now surpasses support for gun control...
Change...
Via Washington Examiner:
Via Washington Examiner:
Exactly two years after President Obama’s bid for gun control following the Sandy Hook Elementary School shooting died in Congress, a new poll has discovered a huge shift in public opinion to backing Second Amendment gun rights and away from controlling gun ownership.
The reason: Americans now believe having a gun is the best way to protect against crime, 63 percent to 30 percent.
Pew Research Center found that while support for gun control once reached 66 percent, it has dropped to 46 percent while support for gun rights has jumped 52 percent, the highest ever in the past 25 years.

Federal District Court Strikes Down Washington D.C. Draconian Handgun Law...
This is a big Second Amendment victory...
Via Legal Insurrection

Well, well, well–I guess the big guy upstairs knew I could do with a pick-me-up while I struggle through this respiratory infection. And boy, did he deliver big (with a h/t to Ace of Spades HQ).
In light of Heller, McDonald, and their progeny, there is no longer any basis on which this Court can conclude that the District of Columbia’s total ban on the public carrying of ready-to-use handguns outside the home is constitutional under any level of scrutiny. Therefore, the Court finds that the District of Columbia’s complete ban on the carrying of handguns in public is unconstitutional.
Palmer v. District of Columbia (1:09-CV-1482 , filed July 26, 2014; full decision at the end of this post).
This should, of course, be the common fate of virtually every gun law currently on the books, particularly when (as is the only proper legal course) strict scrutiny is applied to the thousands of state and Federal laws that continue to irrationally infringe our rights to keep and bear arms.
Kudos to Attorney Alan Gura, for his continuing masterful efforts in defense and promotion of the Second Amendment to the Constitution of the United States of America. As Alan noted in his own blog, Reality-Based Litigation:

Victory: Two Demo lawmakers in Colorado recalled over support for tougher gun control laws
After Congress failed to enact tougher gun laws after the Newtown shooting, these democratic legislators led an effort in Colorado to ban 15-round limits on ammunition magazines and expand background checks on private gun sales. 23 percent of registered voters signed a petition to have a recall vote. They have both now been replaced by republicans.
Via FOX News:
Two Democratic lawmakers in Colorado, including the president of the state senate, were recalled Tuesday in elections brought about by their support for tougher gun control laws.Theys lost in spite of what looks like the usual vote fraud attempts by democrats.
According to unofficial results, voters in Colorado Springs favored recalling state Sen. John Morse, the body's president, by 51 percent to 49 percent. With 100 percent of precincts reporting, state Sen. Angela Giron of Pueblo was defeated in her recall election, 56 percent to 44 percent.
The Colorado Republican Party called the vote results "a loud and clear message to out-of-touch Democrats across the nation" in a statement released late Tuesday. Colorado's Democratic governor, John Hickenlooper, said he was "disappointed by the outcome of the recall elections" before calling on state residents to "refocus again on what unites Coloradans -- creating jobs, educating our children, creating a healthier state -- and on finding ways to keep Colorado moving forward."

Two hooded men, their faces covered, went into a Florida Internet cafe Friday, hefting a baseball bat and toting a handgun. What they couldn't have expected to encounter was Samuel Williams, a fleet-of-foot senior citizen with a gun.
The two suspects, identified by authorities as DuWayne Henderson and Davis Dawkins, went spinning and running after Williams, 71, dropped to one knee and aimed his .380.
Video of the incident at the Palms Internet Cafe in Ocala, Fla., shows two suspects directing patrons, who have their hands raised. Williams, a grandfatherly looking man in billed cap and shorts, stands, then bends briefly to one knee and begins shooting.
The suspects scramble to exit, falling over one another as Williams continues his pursuit....

Gun sales skyrocket and homicide drops off the list of top 15 causes of death
Gun sales have skyrocketed in the last three years and many states has loosened their conceal and carry laws. The bloodbath liberals predicted has failed to materialize. Actually, homicide has dropped off the top 15 causes of death list for the first time since 1965. Take that liberals.
(ABC News)- For the first time in almost half a century, homicide has fallen off the list of the nation's top 15 causes of death, bumped by a lung illness that often develops in elderly people who have choked on their food.
The 2010 list, released by the government Wednesday, reflects at least two major trends: Murders are down, and deaths from certain diseases are on the rise as the population ages, health authorities said.
Homicide was overtaken at No. 15 by pneumonitis, seen mainly in people 75 and older. It happens when food or vomit goes down the windpipe and causes deadly damage to the lungs.
This is the first time since 1965 that homicide failed to make the list, according to the Centers for Disease Control and Prevention.

Concealed handgun instructor runs ad refusing to train liberals, Obama supporters and Muslims
65-year-old Crockett Keller says he will give up his license to teach before training a liberal, Obama supported or Muslim. Keller says Obama supporters have proven they cannot make a knowledgeable and prudent decision.
Concealed handgun instructor runs ad refusing to train liberals, Obama supporters and Muslims
MASON, Texas -- It was a message intended to bring in some extra business. A radio ad for a concealed handgun class at Keller's Riverside Store in Mason, located in the heart of the Texas Hill Country, is causing controversy.
"We will attempt to teach you all the necessary information you need to obtain your C.H.L.," the ad stated. Forty-five seconds in, the advertisement added a disclaimer.
"If you are a socialist liberal and or voted for the current campaigner in chief, please do not take this class. You have already proven that you cannot make a knowledgeable and prudent decision as under the law."
The ad continues, going on to say,"If you are a non-Christian Arab or Muslim, I will not teach you the class with no shame; I am Crockett Keller, thank you and God bless America."
Behind his store off Highway 87 two hours northwest of Austin, 65-year-old Crockett Keller teaches concealed carry courses to earn a few extra dollars. Courses that, he wants to make clear, are not for everyone.
"I call it exercising my right to choose who I instruct in how to use a dangerous weapon," said Keller.

Sarah Palin: Obama Wants to "Gut the Second Amendment" (video)
Sarah Palin speaks the truth about Obama and gun rights:
“Don’t doubt for a minute that, if they thought they could get away with it, they would ban guns and ban ammunition and gut the Second Amendment.”Barack Obama has a long history of being anti-gun and against Second Amendment rights. Political considerations have cause him to put these beliefs on the back burner. President Obama hasn't made any serious overt moves against Americans right to own firearms. However, Obama does seem to be working a long-term strategy to squash the Second Amendment. Both of his Supreme Court nominees are very young and anti-gun. This will impact the Supreme Court for the next three or four decades.

Obama is stimulating ammo sales

Gun owners are fearful the Obama administration will restrict sales. They are rushing to buy ammo and creating a shortage. CNN reported:
AURORA, Colorado (CNN) -- Gun shops across the country are reporting a run on ammunition, a phenomenon apparently driven by fear that the Obama administration will increase taxes on bullets or enact new gun-control measures.
"In the last two months it's gotten very, very difficult to find ammunition," says Richard Taylor, manager of The Firing Line, a gun shop and shooting range in the Denver, Colorado, suburbs.
"There are a lot of rumors floating around that the present government would like to increase taxes on ammunition. I think [there is] just a lot of panicked buying going on."
While campaigning for the White House, Obama supported re-enacting the now-expired ban on assault weapons. But there is no indication that the administration will take up that measure -- or any other gun-control initiative --anytime soon.
Nonetheless, some gun owners aren't taking any chances.
Two weeks ago, The Firing Line was forced to impose a four-box-per-customer limit on ammo. Before that, the shop was selling 10,000 rounds of 9 mm handgun ammunition a day.

Obama makes stealth attack on armed pilot program
After 911, pilots were allowed to have a firearm in the cockpit if they went through extensive background checks and a certification program. This program has been very successful with few problems. Major airline pilots are a very responsible group as you might guess. Now, President Obama is making a stealth attack on the armed pilot program. He is diverting the training money for certification of new pilots entering the program to hiring more personnel to harass the pilots who are currently allowed to be armed in the cockpit. According to the Washingtontimes,
I can not imagine why the Obama Administration would make this move except as part of the overall anti-gun stance. This is the most anti-gun administration to ever occupy the White house.

Americans Against Obama
Now President Obama is quietly ending the federal firearms program, risking public safety on airlines in the name of an anti-gun ideology.
Since Mr. Obama's election, pilots have told us that the approval process for letting pilots carry guns on planes slowed significantly. Last week the problem went from bad to worse. Federal Flight Deck Officers - the pilots who have been approved to carry guns - indicate that the approval process has stalled out.
Pilots cannot openly speak about the changing policies for fear of retaliation from the Transportation Security Administration. Pilots who act in any way that causes a “loss of confidence” in the armed pilot program risk criminal prosecution as well as their removal from the program. Despite these threats, pilots in the Federal Flight Deck Officers program have raised real concerns in multiple interviews.
I can not imagine why the Obama Administration would make this move except as part of the overall anti-gun stance. This is the most anti-gun administration to ever occupy the White house.

Gun rights are under stealth attack again

Gun rights are under stealth attack again. This time the Obama Administration is trying to curb gun rights by exacerbating the current ammunition shortage. Hoarding due to fear of gun ownership rights being restricted has already created a shortage of many types of ammunition. Now, the Department of Defense is stopping the sale of spent brass casings to re-manufacturers. The casings will have to be destroyed before sale. Why is this a problem? A significant portion of pistol and rifle ammunition is provided by the re-manufacturers. This severely curtails their production and puts additional strain on the current short supply. The only reasonable explanation for the DOD to do this is to crimp the supply of ammunition in this country. They will get 80% less money for the shredded casings as scrap metal. The raw metal will probably be sold to China. At least the Chinese will be happy about this.
DOD Ends Sale of Expended Military Brass to Remanufacturers
Got that? From now on, remanufacturers of military brass will not be able to buy surplus brass from DOD--actually from Government Liquidators, llc.--the corporation that sells surplus materials for the U.S. government. At least, not in any form recognizable as once-fired brass ammunition.
Now all brass ammunition will have to be shredded, and sold as scrap.
Georgia Arms, who brought this to our attention, is the 5th largest ammunition manufacturer of centerfire pistol and rifle ammunition in the U.S.
"We're right up there behind Hornady," Larry Haynie told me.
He also told me with the cancellation of his contract to purchase this brass, and the ending of his ability to purchase any more expended military ammunition, he will have to severely curtail his operation--laying off approximately half his 60-person work force.
Haynie further pointed out this move is a stupendous waste of taxpayer money--reducing the worth of the brass some 80%--from casings, to shredded bulk brass. (excerpt) read more at theshootist.net

Gun sales continue to skyrocket and ammo is in short supply

Gun sales continue at an astounding level. Barack Obama has certainly stimulated gun dealers economies. A friend of mine tried to buy 38 special ammo this weekend. He lives in a city with a population of 250,000. He could not find any. Some dealers told him they could not get resupplied until this fall because of high demand. This fear of gun rights coming under attack may be justified. President Obama has assembled a very anti gun cabinet and Democrats control both houses of congress.
Firearm Sales Continue Upward in February
NEWTOWN, Conn. -- Despite an ever-worsening economy and slumping retail sales, firearm sales increased in February, continuing an upswing that began after November's election.
Data from the FBI's National Instant Criminal Background Check System (NICS) show background checks on the sale of firearms jumped 23.3 percent in February when compared to February 2008. The increase follows a 29 percent rise in January, a 24 percent rise in December and a 42 percent jump in November, when a record 1,529,635 background checks were performed.
The continuing increase in firearm sales coincides with an ATF announcement yesterday that firearm retailers may continue to photocopy the Form 4473 -- the federal document required for purchase of a firearm from a licensed retailer -- in its entirety until they receive requested backorders from the Distribution Center. Gun ownership rights are under 'stealth' attack. Hide your guns.

Gun ownership rights are under 'stealth' attack. While Congress and the public have been obsessed with the 'Spendulus Bill', three things have occurred that should make every gun owner fearful. The items are H.R. 45 introduction, confirmation of Eric Holder as Attorney General and the government medical records data base that is mandated in the stimulus bill. Let me explain.
First, H.R. 45 was filed in the House of Representatives by Rep Rush, Bobby L.[IL] on January 6, 2009. This bill will impose severe restrictions for licensing on gun ownership. This anti gun bill requires that all new guns be licensed. The bill goes retroactive after two years. What this means is that two years after the passage of this bill, all firearms in your possession must be registered. This will not just apply to new gun purchases.
Second, Eric holder was confirmed as Attorney General. Eric Holder has a very anti gun record. He supported the District of Columbia’s handgun ban and has argued the second amendment to the Constitution does not protect an individual's right to firearm ownership. Also, Eric Holder has supported national handgun licensing and mandatory trigger locks.
Third, sections 13101 through 13434 of HR 1 will set up the infrastructure to computerize the medical records of all Americans in a government-coordinated database. This database will contain all records of medical and psychiatric treatment. This will include what drugs you have been prescribed. Why is this worrisome? Under the NICS Improvement Act, 150,000 veterans have already been unfairly stripped of their gun rights by the government. These rights were removed without a court hearing. Now, we will all be susceptible to this tactic.
