The case involves 43-year-old Philippines national Shirley Tan, who came to the United States on a visitor's visa in 1989. She overstayed that visa and has been living in a lesbian relationship with a naturalized citizen in Pacifica, California.

Immigration authorities have ordered her to leave the country, but at the urging of homosexual rights groups Senator Diane Feinstein (D-California) intervened, arguing that if Tan's homosexual partner was a man, they could marry, and she could be eligible for residency.

Feinstein has now introduced an emergency immigration bill on behalf of Tan. That means Tan cannot be deported unless Congress votes down the legislation or it is allowed to expire without being reintroduced.

WASHINGTON (AP) -- Millions of Americans enjoying their small windfall from President Barack Obama's "Making Work Pay" tax credit are in for an unpleasant surprise next spring.

The government is going to want some of that money back.

The tax credit is supposed to provide up to $400 to individuals and $800 to married couples as part of the massive economic recovery package enacted in February. Most workers started receiving the credit through small increases in their paychecks in the past month.

But new tax withholding tables issued by the IRS could cause millions of taxpayers to get hundreds of dollars more than they are entitled to under the credit, money that will have to be repaid at tax time.

At-risk taxpayers include a broad swath of the public: married couples in which both spouses work; workers with more than one job; retirees who have federal income taxes withheld from their pension payments and Social Security recipients with jobs that provide taxable income.

The Internal Revenue Service acknowledges problems with the withholding tables but has done little to warn average taxpayers.

"They need to get the Goodyear blimp out there on this," said Tom Ochsenschlager, vice president of taxation for the American Institute of Certified Public Accountants.

Criminal charges were dropped against a high school student in Denver who wore a "NOBAMA" t-shirt to a Michelle Obama speech. Now, can we arrest the morons who thought he should be charged in the first place? Reported by the Denver Post:

Criminal charges against a junior at Dakota Ridge High School, who wore a T-shirt saying "NOBAMA" before an appearance and speech last fall by Michelle Obama at the school, were dropped Thursday.

Blake Benson, 17, was one of three students at the school who chose to "stay and campaign" for Sen. John McCain when Michelle Obama spoke at the school on Nov. 3.

At the time of his arrest, Benson was holding a McCain-Palin campaign sign.

He was handcuffed and taken to the school's administrative office, said Dan Recht, a Denver lawyer who took the case on behalf of the American Civil Liberties Union, which represented Benson.

Benson was given a "promise to appear" citation by a Jefferson County sheriff's deputy and accused of "interference with staff of an educational facility," said Recht. The Jefferson County Sheriff's Department decided not to forward the citation to prosecutors, effectively dropping the case.

Recht said Benson also was given a one-day suspension by the school. Shortly after the incident, the school rescinded the suspension.

Recht said he learned Thursday that authorities would not pursue the interference charge.

"There is no more classically protected speech than peacefully protesting against one candidate and for another," said Recht. "What Blake Benson was doing is as American as apple pie."

David Souter was appointed to the Supreme Court in 1990 by President George H.W. Bush. He was alleged to be a conservative by then Chief of Staff John Sununu. After his appointment, Souter was quickly seduced by the left wing of the court and he never looked back. He has become one of the most liberal and despised members ever to wear the black robes of a Supreme Court Justice. Souter supports the right of the government to seize peoples property(eminent domain) even when the use is for a nonpublic project such as a shopping center or football stadium. This spawned a failed movement to have his house in Connecticut seized under eminent domain and turned into a hotel.Fox News is reporting:

Supreme Court Justice David Souter has reportedly decided to retire from the Supreme Court, a move that will provide President Barack Obama his first opportunity to nominate someone to the nation's highest court.

The White House has been told that Souter will retire in June, when the court finishes its work for the summer, a source familiar with his plans said Thursday night. He almost certainly would remain on the bench until a successor is confirmed.

FOX News has not independently confirmed the report. The source spoke to The Associated Press on condition of anonymity because he was not authorized to speak for Souter.
