Josh Earnest declares Trump unqualified because "The first thing a president does, when he or she takes the oath of office, is to swear an oath to preserve, protect and defend the Constitution of the United States,"

Unintentional Irony: 
NEW YORK – White House Press Secretary Josh Earnest spoke frankly about Donald Trump's proposed Muslim ban Tuesday, and unintentionally inspired the hilarious #TrumpIsDisqualifiedParty trend on Twitter in the process.
"The first thing a president does, when he or she takes the oath of office, is to swear an oath to preserve, protect and defend the Constitution of the United States," Earnest said.  "And the simple fact is, that what Donald Trump said yesterday disqualifies him from serving as president."
Trump sparked an international backlash when he said that the United States should ban all Muslims from entering the country in the wake of the San Bernardino shootings.
Does Earnest know who he works for?

I'd like to know when the rights awarded to US citizens under the Constitution of the United States pertained to NON citizens?

Maybe Josh would like to answer that question.

The Constitution does not mention immigration. Congress can pass what ever laws they want.
